Terms of Use for Rentings

Effective Date: 18 June 2025

1. Welcome to Rentings

1.1 Rentings Technologies (Pty) Ltd, trading as Rentings ("Rentings", "we", "us", or "our"), operates a platform that allows:

(a) users to advertise items for rent (such users being "owners");

(b) owners to communicate with and enter into agreements with other users to rent items (such users being "renters");

(c) renters to pay owners for renting the relevant items; and

(d) users to resolve disputes concerning rented items, which we make available through our website at https://rentings.co.za (the "Rentings Service").

1.2 These Terms of Use, together with any documents referred to herein (collectively, the "Terms"), govern your use of the Rentings Service. By accessing or using the Rentings Service, you agree to these Terms. If you do not agree, please do not use the Rentings Service.

2. Important Notices About Lending and Renting Items

2.1 Rentings provides a platform to facilitate the renting and lending of items between users but does not rent or lend items itself. We do not routinely inspect or monitor the quality, safety, or legality of items listed for rent by owners on the Rentings Service.

2.2 If you are an owner, you are responsible for ensuring that:

(a) your items comply with descriptions provided, are fit for purpose, and are safe to use;

(b) you comply with all applicable South African laws, including the Consumer Protection Act 68 of 2008 (CPA), ensuring renters' consumer rights are upheld and compensating for any harm caused by defective items.

2.3 If you are a renter, you are responsible for:

(a) the proper care and return of rented items in the condition received, subject to reasonable wear and tear;

(b) any damage caused to the item due to negligence, carelessness, improper use, lack of appropriate skills or experience, or theft, as determined by the Rentings Service;

(c) any damage caused to other persons or property while using rented items.

2.4 Rentings is not liable for any loss, damage, or injury resulting from the use of items rented through the Rentings Service, except as required by South African law, including the CPA.

3. Your Relationship with Us

3.1 These Terms set out the basis of your relationship with Rentings. Please read and understand them before using the Rentings Service.

3.2 Additional terms apply depending on whether you are an owner (see clause 9) or a renter (see clause 10).

3.3 By using the Rentings Service, you confirm that you are legally capable of entering into binding agreements under South African law.

4. Information About Us

6. The Rentings Service

6.1 The Rentings Service enables owners to list items for rent, communicate with renters, and enter into rental agreements. It also facilitates payments and dispute resolution between users.

6.2 We may offer social features, such as messaging or sharing rental experiences, which must comply with our Rules of Acceptable Use (clause 14).

6.3 The Rentings Service is provided on an "as is" and "as available" basis, subject to the provisions of the CPA and ECTA.

7. Setting Up Your Account

7.1 To use the Rentings Service, you must create an account using your email address ("Account"). You must create a strong password (using a combination of upper- and lower-case letters, numbers, and symbols).

7.2 You must be at least 18 years old or have the legal capacity to enter into binding agreements in South Africa. If you are under 18, a parent or guardian must agree to these Terms on your behalf.

7.3 You are responsible for maintaining the confidentiality of your Account details and for any activities under your Account. If you suspect misuse, contact us immediately at info@rentings.co.za.

8. Your Right to Use the Rentings Service

8.1 The Rentings Service, including its content and materials, is owned by us or our third-party licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Rentings Service solely for its intended purpose, subject to these Terms.

8.2 You may not:

(a) copy, modify, or distribute any part of the Rentings Service;

(b) attempt to access or reverse-engineer the source code of the Rentings Service;

(c) transfer your right to use the Rentings Service to another person;

(d) use the Rentings Service for any unlawful purpose or in violation of these Terms.

8.3 All intellectual property rights in the Rentings Service remain with us or our licensors.

9. Owner-Specific Terms

9.1 This clause applies if you are an owner.

9.2 You must not list items that are illegal to rent in South Africa, including motorised vehicles, firearms, weapons, hazardous materials, or items that violate public morals or our reputation. We may remove such listings at our discretion.

9.3 You are responsible for ensuring that:

(a) you have the legal right to rent out listed items, and their use does not infringe third-party rights;

(b) items are delivered to renters as agreed;

(c) item descriptions, prices, and other information are accurate, complete, and include any defects, restrictions, or safety instructions;

(d) items are safe, fit for purpose, and comply with the CPA.

9.4 You must only hand over items to the verified renter after the transaction is approved through the Rentings verification process.

9.5 If you offer storage space, you must ensure it is safe, secure, and free from leaks or extreme conditions. You are liable for any damage to items stored in your space.

9.6 You may agree on additional rental terms with renters, including the rental fee ("Hire Fee"), which must include all applicable taxes and delivery costs.

9.7 Once agreed, you may not amend rental terms unless the renter consents and there is a valid reason.

9.8 You may cancel a rental agreement up to 48 hours before the rental period starts. Cancellations within 48 hours may incur a cancellation fee of 30% of the Hire Fee.

10. Renter-Specific Terms

10.1 This clause applies if you are a renter.

10.2 Renting an item grants you a limited, personal right to use it during the rental period, which cannot be transferred to another person.

10.3 You are responsible for:

(a) ensuring you are legally permitted to use the rented item;

(b) complying with all applicable laws, including the CPA;

(c) following the owner's reasonable instructions for safe use;

(d) returning the item in the same condition, subject to reasonable wear and tear.

10.4 If renting storage space, you must ensure stored items are not hazardous, flammable, or valued above R50,000. You are liable for any damage caused by your stored items.

10.5 You must return rented items by the agreed deadline. Late returns may incur late fees ("Late Fees") as determined by Rentings.

10.6 You are liable for loss or damage to rented items due to negligence, carelessness, improper use, lack of skill, or theft, as determined by Rentings.

10.7 You may cancel a rental request before payment. Post-payment cancellations are subject to our cancellation policy (Flexible, Medium, or Strict), available at https://rentings.co.za/faq/cancellation-policy.

10.8 If you fail to return an item on time or are uncommunicative, Rentings may charge a holding deposit up to the item's value ("Holding Deposit"), refundable less any fees owed upon return, repair, or replacement.

11. Items in Transit and Third-Party Courier Services

11.1 Rentings is not liable for loss or damage to items during transit via third-party courier services.

11.2 If a courier is used, the owner or renter must file claims directly with the courier for any loss or damage.

11.3 We strongly recommend researching courier services before use.

12. Fees and Payment

12.1 If you are an owner, we collect the Hire Fee and transactional fees on your behalf and transfer the Hire Fee to you after a 5-day grace period once the item is returned to you, less a 8% transactional service fee ("Platform Transaction Fee"), unless payment is refused or flagged for fraud.

12.2 If you are a renter, you will be charged the Hire Fee plus a booking fee of 2.5% of the Hire Fee ("Platform Booking Fee") for any item category.

12.3 Unpaid fees (Hire Fee, Platform Booking Fee, Platform Transaction Fee, Late Fee, or Settlement Fee) may result in account suspension until payment is made, without prejudice to other remedies.

13. Your Content

13.1 Any images, text, or reviews you upload to the Rentings Service ("User Content") must comply with our Rules of Acceptable Use.

13.2 You grant us a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, modify, and distribute your User Content to provide the Rentings Service.

13.3 You must ensure you have the right to grant this licence for any third-party content included in your User Content.

13.4 We may monitor, reject, or remove User Content that violates our Rules of Acceptable Use.

14. Rules of Acceptable Use

14.1 When using the Rentings Service, you must not:

(a) interfere with security features;

(b) provide false information or impersonate another person;

(c) use the Rentings Service if suspended or banned;

(d) engage in illegal or harmful conduct;

(e) advertise goods or services other than items listed for rent;

(f) send unsolicited marketing communications;

(g) introduce viruses or harmful material;

(h) collect data not permitted by these Terms;

(i) submit User Content that is abusive, obscene, or infringing;

(j) enter agreements outside the Rentings Service with users met through it ("Fee Avoidance"), which incurs a penalty of double the avoided fees or R2,000, whichever is higher.

14.2 Breach of these rules may result in:

(a) suspension or termination of your access;

(b) removal of User Content;

(c) warnings or legal action;

(d) disclosure to law enforcement, as required by South African law.

15.1 If content on the Rentings Service infringes your rights, send an Infringement Notice to info@rentings.co.za, including:

(a) your name and contact details;

(b) a statement explaining the infringement or violation;

(c) identification of the problematic content.

15.2 We will review and respond to Infringement Notices in accordance with South African law, including the ECTA.

16. Resolving Disputes Between Renters and Owners

16.1 Users are encouraged to resolve disputes directly. Renters must notify owners of any damage or loss immediately or within 3 days from when the damage or loss occurred.

16.2 Owners must provide evidence (e.g., photos, proof of purchase) to support claims for reimbursement.

16.3 If disputes cannot be resolved, Rentings may mediate and charge a settlement fee of up to 30% of any amounts payable by the renter ("Settlement Fee"). Our decision is final, and Renters agree to pay any determined amounts.

16.4 Payments owed must be made within 48 hours, or Rentings may debit your account.

17. Owner Guarantee

17.1 Rentings will not reimburse owners for repair or replacement costs unless a refundable deposit was paid for the item. In such cases, we will deduct compensation from the refundable deposit, based on the item's market value, not exceeding the deposit amount. Rentings does not accept personal or business liability for unrecoverable repair or replacement costs.

17.2 Reimbursed owners must inform renters that amounts owed are now payable to Rentings.

17.3 For more details, see https://rentings.co.za/terms.

19. Our Liability to You

19.1 The Rentings Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free use, subject to the CPA and ECTA.
